Florida State Quarterback Jameis Winston is facing a lawsuit which was filed by Erica Kinsman, a former student at Florida State University who claims that Winston raped her back in 2012. This news comes just two weeks before the NFL draft begins a draft in which Winston is expected to go first.
The lawsuit was filed early Thursday morning by Kinsman in an Orlando based circuit court. The lawsuit details the alleged rape event which took place back in 7th December 2012. According to Kinsman the event that took place that December left her emotional distress. In addition to that she went through assault, sexual battery and false imprisonment. As a result Kinsman is asking for an excess of $15,000in damages.
According to Kinsman attorney, John Clune, him and his colleague Baine Kerr filed the lawsuit once they were ready. Following an initial decision which had been reached upon by FSU, the two attorneys filed a federal Title IX lawsuit against Florida State University back in January.
"Mr. Winston's never been held accountable for what he did," Clune said. "Had been prosecuted or had he been held accountable by the university, then maybe this wouldn't be such an important step. The processes that we expect to do the right thing failed, and if they're not going to hold him accountable she can do it herself."
According to Kinsman, she had reported the whole event to the police but they failed to take any action in terms of collecting evidence and sat dormant for almost nine months until the story was covered on the media back in November 2013.
Winston is expected to be top pick in these year’s NFL draft which is scheduled for 30th this month.
